Q: Who in the school system is responsible for developing the local wellness policy required by law?A: Local boards of education were required to adopt a wellness policy no later than the first day of the school year which began after June 30, 2006. Typically, the superintendent of the local school district would assign a staff member to be responsible for the processes involved in preparing a policy for board approval.
Q: Who will monitor the local educational agencies to determine if they have adopted a local wellness policy and are in compliance with the law?
A: USDA has issued a policy memo that directs state agencies that have oversight of the Child Nutrition Program to ensure that each local school district has been notified of its responsibility to establish a local wellness policy. In Georgia, the Georgia Department of Education fulfills this function. Compliance is to be accomplished through the regular Coordinated Review Effort (CRE) or School Meals Initiative (SMI) reviews that must be scheduled in every school district every five years. If a school system does not have a wellness policy in place when it is reviewed, the state agency should require corrective action. The state agency has no obligation to review and evaluate the content of the local wellness policy since the policy is a local decision. Evaluation of the local policy should be planned by those members of the community who were involved with the development of the policy.
